1. General Information

Thanks for choosing Get A Mailbox by [dk worldwide,inc] as your Hosting and Email Service (the "Service").

Get A Mailbox by [dk worldwide,inc]'s acceptable use policy. All customers of Get A Mailbox by [dk worldwide,inc] agree to be governed by the policies set forth herein. Please read the following terms and conditions ("T&C’s") of the Service. If you don’t want to be bound by these T&C’s, do not accept the Service. We want the T&C’s to meet your needs and the needs of our other customers and we expect that these T&C’s will evolve over time. We will post the T&C’s including any changes, in the "Hosting" section of the Get A Mailbox by [dk worldwide,inc] Web site (http://www.getamailbox.com/accept.html) and we ask that you periodically review them. Any changes or modifications to these Terms and Conditions of Contract thereto are agreed to by the both parties upon renewal of Services.

2. Invoice & Payment

You agree to pay all charges for the Service selected by you, including all monthly fees, additional product charges, and optional charges. You authorize us to automatically invoice any amounts due by you pursuant to the terms of the billing option selected by you.

Get A Mailbox by [dk worldwide,inc] may change the amount of any charge with thirty (30) days notice to you.

Invoices for the Service are sent via e-mail, to an e-mail address you designate, on the 1st of every month and are due by the 15th of that same month. If Get A Mailbox by [dk worldwide,inc] does not receive payment in full before the 15th of that same month, you are subject to a $25.00 late charge. If Get A Mailbox by [dk worldwide,inc] does still not receive payment in full before the 20th of that same month Get A Mailbox by [dk worldwide,inc] has the right to withhold, or suspend Service. Once Service is suspended you are subject to a $75.00 reconnection fee.

Accounts are billied annually for your Service. You will be invoiced as much as 3 months in advance of the expiration of the Service to ensure continuous, uninterrupted service.

3. Duties Of Get A Mailbox by [dk worldwide,inc]

Get A Mailbox by [dk worldwide,inc] will provide the Service selected by you as described in the Hosting section of the Get A Mailbox by [dk worldwide,inc] Web Site located at www.getamailbox.com/hosting.html. Get A Mailbox by [dk worldwide,inc] may change the description of Service upon thirty (30) days notice to you. If you so choose Get A Mailbox by [dk worldwide,inc] will attempt to acquire an Internet Domain Name on your behalf. You hereby waive any claims which you may have against Get A Mailbox by [dk worldwide,inc] for any loss, damage, claim or expense arising out of, or in relation to, the registration or attempted registration of such Domain Name in any online or offline network directories, membership lists or registration lists, or the release of the Domain Name from such directories or lists following the termination of Service by Get A Mailbox by [dk worldwide,inc] for any reason. Get A Mailbox by [dk worldwide,inc] makes no warranty or representation that the requested Domain Name will be available for registration.

4. Limitation Of Get A Mailbox by [dk worldwide,inc]'s Obligations And Liability

Get A Mailbox by [dk worldwide,inc] WILL UTILIZE ITS BEST EFFORTS TO MAINTAIN ACCEPTABLE PERFORMANCE OF THE CONTRACTED FOR SERVICE, BUT Get A Mailbox by [dk worldwide,inc] MAKES ABSOLUTELY NO WARRANTIES WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Get A Mailbox by [dk worldwide,inc] cannot guarantee continuous Service, Service at any particular time, or integrity of data stored or transmitted via its system or via the Internet. Get A Mailbox by [dk worldwide,inc] will not be liable for the inadvertent disclosure of, or corruption or erasure of, data transmitted or received or stored on its system. Get A Mailbox by [dk worldwide,inc] will not be liable to you or any of your customers for any claims or damages which may be suffered by you or your customers, including, but not limited to, losses or damages of any and every nature, resulting from the loss of data, inability to access Internet, or inability to transmit or receive information, caused by, or resulting from, delays, non-delivery, or Service interruptions whether or not caused by the fault or negligence of Get A Mailbox by [dk worldwide,inc]. Get A Mailbox by [dk worldwide,inc] will not be responsible for your Web site not being accessible on the Internet due to circumstances not in the direct control of Get A Mailbox by [dk worldwide,inc] such as individual Internet user's own equipment capabilities, limitations, Internet service provider limitations and/or browser software limitations. The display of your Web site may vary from the submitted proof due to the variety of Web browsers, monitors and Internet access available. Get A Mailbox by [dk worldwide,inc] created Web pages will be designed to be viewed by the most commonly used browsers and monitors. In addition, your Web site will not be displayed while the host server is undergoing maintenance.


Get A Mailbox by [dk worldwide,inc] may discontinue any Service, or may require fulfillment of conditions.
Get A Mailbox by [dk worldwide,inc] may choose to impose as a prerequisite for continuing any Service upon thirty (30) days notice to you.

Get A Mailbox by [dk worldwide,inc]'s liability to you, and any end user of the Service or any other Get A Mailbox by [dk worldwide,inc] service is limited to the amount paid to and received by Get A Mailbox by [dk worldwide,inc] for Service not accepted. In no event will Get A Mailbox by [dk worldwide,inc] be liable to you, or any end user or any other entity for any special, consequential, or other damages, however caused, whether for breach of contract, negligence or otherwise, even if Get A Mailbox by [dk worldwide,inc] has been advised of the possibility of such damage.

You will take all necessary measures to preclude Get A Mailbox by [dk worldwide,inc] from being made a party to any lawsuit or claim regarding the Service provided to you or any end user. You hereby agree to indemnify and hold harmless Get A Mailbox by [dk worldwide,inc] from any and all claims of whatever nature brought by any of your customers against Get A Mailbox by [dk worldwide,inc] in excess of the remedy set forth herein.

6. Property Rights

Get A Mailbox by [dk worldwide,inc] owns all right, title and interest in Get A Mailbox by [dk worldwide,inc]'s trade names, service marks, inventions, copyrights, trade secrets, patents, and know-how relating to the design, function, or operation of Plans and of the hardware and software systems and resources necessary to provide the individual Service elements of which they consist. This Agreement does not constitute a license to you to use Get A Mailbox by [dk worldwide,inc]'s trade names or service marks. The ownership of the content of your Web site will at all times remain with you, unless payment for design work is outstanding.

Customer warrants that it has the right to use the applicable trademarks, if any.

7. Disputes

We will attempt to resolve all disputes arising out of this Agreement in a spirit of cooperation without formal proceedings. Any dispute which cannot be so resolved (other than the collection of money due on unpaid invoices) will be subject to arbitration upon written demand of either party.

Should any legal action permissible under this Agreement be instituted to enforce the terms and conditions of this Agreement, in particular the right to collect money due on unpaid invoices, the prevailing party will be entitled to recover reasonable attorney's fees and expenses incurred at both the trial and appellate levels.

8. Refund Policy

No refund is available after the 10th day for the current Service. All cancellations must be received in writing 30 days prior to the cancellation date. Regular mail, email and fax notifications are acceptable. Telephone cancellations do not constitute notification. This policy does not apply to any additional services such as overages, additional disk space, additional POP accounts, etc. On cancellation, you are responsible to remove your Web site from the Service.

Domain registrations are not refundable under any circumstances.

9. Assignment

Your rights and obligations under this Agreement may not be transferred or assigned directly or indirectly without the prior written consent of Get A Mailbox by [dk worldwide,inc], which consent will not be unreasonably refused. This Agreement may be assigned to another party by Get A Mailbox by [dk worldwide,inc].

10. Partial Invalidity

If any provision of this Agreement is held to be invalid by a court of competent jurisdiction, then the remaining provisions will nevertheless remain in full force and effect. We agree to renegotiate in good faith any term held invalid and to be bound by mutually agreed substitute provision.

11. Applicable Law, Jurisdictional Matters

This Agreement is governed by and construed under the laws of the State of Illinois and the United States of America. The federal and state courts of the State of Illinois will have exclusive jurisdiction to adjudicate any non-arbitrable dispute arising out of this Agreement.

13. Age

The Customer certifies that he or she is at least 18 years of age, or that their parent or legal guardian will act as the "customer" in terms of this contract.

14. Internet Etiquette

Electronic forums such as mail distribution lists and Usenet news groups all have expectations regarding subject area and appropriate etiquette for posting. Users of these forums should be considerate of the expectations and sensitivities of others on the network when posting material for electronic distribution. The network resources of Get A Mailbox by [dk worldwide,inc] may not be used to impersonate another person or misrepresent authorization to act on behalf of others or Get A Mailbox by [dk worldwide,inc]. All messages transmitted via Get A Mailbox by [dk worldwide,inc] should correctly identify the sender; users may not alter the attribution of origin in electronic mail messages or posting.

Users must not attempt to undermine the security or integrity of computing systems or networks and must not attempt to gain unauthorized access.

15. Lawful Purpose

Customer may only use Get A Mailbox by [dk worldwide,inc] for lawful purpose. Transmission of any material in violation of any Country, Federal, State or Local regulation is prohibited. To this effect, child pornography is strictly prohibited as well as housing any copyrighted information on Get A Mailbox by [dk worldwide,inc] for the purpose of illegal distribution or infringement.

Customer agrees to not have any content on their site that advocates, sells or in any way makes available tools or methods to send unsolicited e-mail or usenet postings (spam), or to use Get A Mailbox by [dk worldwide,inc] for relaying unsolicited e-mail or usenet postings, or to use unsolicited e-mail or usenet postings to advertise for their site hosted at Get A Mailbox by [dk worldwide,inc]. Any complaint we receive about a violation of this or the preceding two points will be taken very seriously and will result in immediate account cancellation without a refund.

16. Entire Agreement; Modifications

This Agreement sets forth the entire Agreement and understanding between the parties and merges all prior discussion between them. Utilization of the Service by you and/or your customers following the effective date of any change or modification of this Agreement will constitute acceptance by you of such change(s). Otherwise, this Agreement may not be modified except by the of written consent of both parties. By delivering initial payment or renewal payment you agree to all terms and conditions outlined in this document and to pay Get A Mailbox by [dk worldwide,inc] any and all fee associated to your Services.
